STEVEN PAUL HIRSCHFIELD'S DEATH RULED A HOMICIDE

(San Diego, California) The death of a 37-year old gay man who was shot last month by San Diego Harbor Police during a gay pride-related cruise was been ruled a homicide according to the county coroner’s final report.

But the report also noted that toxicology findings show that Steven Paul Hirschfield had a number of illegal drugs in his system.
Hirschfield’s blood showed “the presence of methamphetamine, doxylamine, and trace ketamine in his blood,” according to the report. But, there was no sign of alcohol in the blood.

The official cause of death, however, was listed as a gunshot wound to the chest.

The coroner’s report says that the fatal shot was fired by a “departmentally-issued Glock 40 loaded with issued 0.40 caliber jacketed hollow points.”

“The gunshot wound entrance was on the right midback,” and exited through the right part of his chest the report said.

Hirschfield, 37, of West Hollywood, went overboard during a July 19 pride related cruise in San Diego Harbor.

Harbor Police were notified by the operators of the charter boat and Hirschfield was rescued but reportedly began fighting with officers who pulled him onto their boat.

He allegedly grabbed a Taser from one officer and struck him in the face. Police said he then attempted to take the officer’s handgun.

As the two struggled a second officer shot Hirshfield. He was pronounced dead by paramedics when the police boat docked.

“The police officer who executed Steven Hirschfield shot him from behind,” Brian Claypool, an attorney hired by Hirchfield’s family told KOGO television.

“It is our belief, based on a witness account and information learned through the autopsy performed by the San Diego County coroner, that Mr. Hirschfield was not the aggressor and was not involved in a brawl with police officers prior to being executed by this police officer.”

Hirchfield’s family has filed two claims seeking $20 million dollars from the San Diego Harbor Police.

The suits accuse the officers involved in the shooting of killing Hirschfield without justification.

Both officers have been placed on paid administrative leave while the San Diego Police Department conducts an investigation.

PARENTS WANT $20 MILLION IN SHOOTING OF THEIR SON FROM SAN DIEGO POLICE DEPT.

The parents,  Alan and Nicole Hirschfield,  of Steven Paul Hirschfield, the dancer that was shot and killed by police who were sent to rescue him after he went overboard on a nighttime boat cruise at the San Diego Gay Pride celebrations in July are wanting $20 million from the San Diego Police Department and the office responsible for the death of Hirschfield.


From the San Diego Union Tribune, the paper reports:

"Brian Claypool, the Los Angeles attorney representing the Hirschfields, is levying anti-gay accusations against Harbor Police Chief Kirk Sanfilippo, who is not commenting on the allegations. The one-page claims make no reference to homosexuality. They accuse police of killing Hirschfield without legal justification. The officer who fired his gun, Clyde Williams, and his partner, Wayne Schmidt, have been placed on routine paid administrative leave pending the results of a San Diego police investigation. 'The public, including me, is not privy to the information the San Diego Police Department relies on to reach its conclusion,' Claypool said. 'The only way to level the playing field is through a lawsuit. Then we can gather, through discovery, all of the physical evidence and witness statements from the San Diego police. If we don't file a lawsuit, we'll never be able to reconstruct the shooting.' John Gilmore, a spokesman for the San Diego Unified Port District, which includes the Harbor Police, said the department is standing by the officers' account of what happened that night."

FAMILY OF WEHO MAN KILLED IN SAN DIEGO PLANS TO SUE

Steven Hirschfield's family does not believe the police accounts and plans to sue.

Hirschfield was the dancer who fell overboard into the water from a gay pride party boat in San Diego.

"The officer who shot him had a Taser – why didn't he use it? And if he was in a brawl, why isn't there more evidence of that? There was very little scratching or bruising on his body."

KNBC: "Results of an autopsy released Monday showed he died from a gunshot wound to the chest. Claypool said medical examiners confirmed Hirschfield was shot in the back and his family believes officers acted with "excessive force" and disputes accounts given by police. 'It is our belief based on a witness account and information learned through the autopsy performed by the San Diego County coroner that Mr. Hirschfield was not the aggressor and was not involved in a brawl with police officers prior to being executed by this police officer,' [their] attorney [Brian Claypool] said."

KNBC continues:Claypool said his suit would seek punitive damages from the Harbor Police Department. He told KNSD-TV he was first contacted about the case by a civil rights watchdog group that monitors alleged police brutality matters.
"I think this is a gay-rights issue," Claypool said.
